www.lexvivens.com ("we," "us," or "our") is a platform dedicated to empowering legal professionals by providing cutting-edge AI tools, educational content, and resources. These offerings are designed to enhance the standards and efficiency of legal practice, aligning with our mission to foster the "Living Law" concept—law as an evolving and dynamic force that should serve an ever evolving society. 

We provide subscription-based content and services tailored to the legal profession. Our offerings include AI tools designed specifically for legal practitioners, as well as educational content such as tutorials on how to effectively use these tools. These Terms govern your use of the Website, the App and its services, including all AI-related content and features. Please read these Terms carefully before using the Website or the App.

2. Eligibility

You must be at least 18 years old or have reached the age of majority in your jurisdiction to use this Website or App. By accessing the Website or the App, you warrant that you meet these eligibility requirements and that you have the legal capacity to enter into a binding agreement.

3. Subscriptions and Billing

3.1 Subscription Plans

We offer various subscription plans, details of which are provided on the Pricing Page of the Website. Plans may include access to AI tools, tutorials, and other educational resources. By subscribing, you agree to pay all applicable fees associated with your selected plan and its features.

3.2 Payment

Payments are processed through secure third-party payment gateways. By providing your payment information, you authorise us to charge the applicable subscription fees. We are not responsible for any additional charges imposed by your financial institution.

3.3 Renewal and Cancellation

Subscriptions automatically renew at the end of each billing cycle unless cancelled. You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period. No refunds will be provided for partial subscription periods.

3.4 Promotions and Prizes

From time to time, we may offer promotional discounts, credit vouchers or prizes and give-aways. These are subject to specific terms and conditions outlined during the offer period and will be completely discretionary.  

Any accrued benefits will be forfeited upon breach of the Subscriber Agreement. 

4. User Accounts

4.1 Account Creation

4.2 Account Security

4.3 Account Termination

We reserve the right to suspend or terminate your account if you breach these Terms, misuse the Website, the App or engage in any other prohibited activities, such as violating the LexVivens Community Forum Policy.

All content provided on the Website and the App, including text, graphics, videos, tutorials, AI tools (e.g., Juriscribe and LexLytic), and other materials, is the intellectual property of www.lexvivens.com or its licensors. Unauthorised use, reproduction, or distribution of the content is strictly prohibited.

5.2 Limited License

Subscribers are granted a non-exclusive, non-transferable license to access and use the content and AI tools for personal and professional purposes. Any attempt to reverse-engineer, replicate, or resell the tools is prohibited.

5.3 Risks Associated with AI Tools

Our AI tools, including Juriscribe for transcription, LexVA for virtual assistants, and LexLytic for legal research, are designed to assist legal professionals but are not substitutes for professional judgment, legal advice, or compliance with applicable laws. 

Users are responsible for:

  • Verifying the accuracy and relevance of AI-generated outputs;

  • Ensuring compliance with legal and ethical standards when using AI-generated content;

  • Understanding the limitations and potential biases inherent in AI systems.

WE DISCLAIM LIABILITY FOR ANY ERRORS, OMISSIONS, OR ADVERSE CONSEQUENCES ARISING FROM THE USE OF OUR AI TOOLS.

6. Prohibited Activities

You agree not to:

  • Use the Website, the App or its content for unlawful purposes;

  • Share your subscription credentials with others;

  • Attempt to reverse-engineer, modify, or hack the Website, the App or its AI tools;

  • Post or transmit harmful, offensive, or misleading content;

  • Misuse the AI tools in a manner that violates ethical or legal standards.

7. Disclaimers and Limitation of Liability

Likewise, any changes to the terms of any of our policies, T’s and C’s or the Subscriber Agreement will be announced on the LexVivens Community Forum as well.

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa (“RSA”). Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in RSA.
